Terms and Conditions

FINANCIAL -

All of Pride Performance Gym memberships have a minimum contract. Memberships are rolling on a 1 cycle basis after the original contract time unless you sign up for a membership which is paid in set terms such as 3, 6 or 12 months.

If you stop paying or leave before your original contract is up, the remaining cost is due in full at that time. Please see below for cancellation terms and conditions.

If you are paying by direct debit and you fall behind with your membership fees and this is not caused by a bank error, we may charge reasonable late fee's, administration fees or suspend or cancel your membership; and we may pass your details to a debt-collection company to recover any outstanding payments.

We may decide to increase our membership fees, but your fees will not increase in your minimum commitment period. We will give you a minimum of 14 days' notice of any fee change via email.

Payments are paid upfront and are non refundable.

ACCESS TO THE GYM -

If you have off-peak membership, you can only use your membership during the specific times made clear on signing up. Please note these times are in the information of each membership type. Before joining, please make sure you are aware of all of the membership options and which membership allows you to access different classes and times of the gym.

OFFERS -

We have the right to remove any offers and discounts at any time with no notice. If you sign up as part of an offer, your commitment period begins at the end of that offer e.g you sign up under an offer of 'sign up in March and get 1 month free'. You sign up on 15th March with your first payment being taken on the 15th April. Your commitment period will start on the 15th April.

MEMBERSHIP HOLD

We may agree to hold your membership if you are unable to attend due to an injury - a doctors note must be supplied - or pregnancy. There may be certain personal circumstances where we agree to hold your membership. Contact the gym to discuss your personal circumstances.

You cannot hold your membership within your minimum commitment period unless a doctors note is provided. If you hold your membership within your initial minimum term, these ‘held months’ do not count towards your initial minimum term.

Membership holds will begin from the date of which you pay your membership fee's.

You will still be required to give a cancellation notice of 30 days if a membership is cancelled when held. You will still be required to pay a final payment of 30 days processing on the day of cancellation and we may charge a reasonable admin fee to do this.

CANCELLATION POLICY -

We can cancel your membership if: you have seriously broken the gym rules, put yourself or another gym member / staff in danger through misuse of equipment or any terms of your contract. We can also cancel your membership if you do not pay any fee or charge within seven days of the date it was due, and we have written to you and / or sent a further invoice giving you a further opportunity to pay; our permanently closes (if this happens, we will refund any membership fees you have paid upfront for a period of membership that has not yet been completed); or for any other reason if we consider it necessary to end your contract.

Once your contract is up, Pride Performance Gym has a 30 day cancellation notice. When cancelling, a 30 day notice period will apply to your account. You'll be charged the full monthly amount up until the end of the 30 day period.

When cancelling, you must do so through the gym or your TeamUp account and should not cancel your direct debit directly through the bank.

If you cancel your direct debit prior to, or without cancelling your gym membership, the amount of money owed will be totalled up until the day your membership ends. Example: If you are to cancel your direct debit in November but only cancel your membership in February, the amount you are required to pay will be until the end of your membership in February.

SESSION CANCELLATION

If cancelling a session, you must give more than 24 hours notice. Cancellations within this 24 hour period will be charged full session cost including no-shows.

If this refers to a class which you have signed up to on and you are on a set number of class membership (e.g weightlifting club 2 sessions per week) then the late cancellation / no show will still be counted towards your weekly usage.

If this refers to personal training sessions and you have purchased a pack, the late cancellation / no show will still be counted towards your pack usage.

If a session is cancelled by Pride Performance, it will be rearranged or an alternative will be added. Classes and opening hours may vary due to coaching at competitions of members.

MISCELLANEOUS TERMS

To hold a membership, you must be 18 or over.

To hold a youth membership, you must be in high school or college and between the ages of 11 and 17. You can only attend the youth classes which your membership states. Any use of open gym will only be allowed if deemed suitable by your coach and with parental permission and signature of parental documents.

To hold a cub membership, you must be in years 3 - 6 in Primary school and between the age of 7 and 11. You can only attend the cub classes which your membership states. All cubs are parents responsibility before, during and after cubs sessions.

You may bring your children to the gym with you however they are your responsibility. Pride Performance take no responsibility for any children on the premises. You may be asked to leave and remove your children from the premises if they cannot be controlled, their behaviour puts themselves or other members / staff in danger and / or they are not following gym rules, e.g. staying within the specific children's area.

There may be occasions where we have to close all, or part of, the gym where you train. Classes and opening hours may vary due to coaching at competitions of members. Where this happens, you will be offered an alternative and sessions will be rearranged. If sessions which are offered multiple times per week are cancelled, we are not required to refund or rearrange one off cancellations, e.g. if a bootcamp session is cancelled, we offer multiple other bootcamp sessions which are available for your membership of 2 sessions per week to be met. We will endeavour to advise you of any closures in advance where possible, unless the issue is urgent or an emergency.

We will not be liable for or responsible for any failure to perform any of our obligations under this agreement which are caused by any event that is outside our reasonable control.

Our staff, agents and subcontractors are not medically qualified so if you have any doubts about your fitness or capability to exercise, we strongly recommend that you get advice from a doctor first. Your health and safety forms will ask for full honesty and disclosure of your health.

For safety reasons, you are responsible for correctly using all club facilities and reading club signs.

We recommend that all members complete an induction to the gym and you should ask for one if we do not offer you one. If you are not sure how to use any equipment, always ask a member of staff.

Use of other professionals at the gym are not linked to Pride Performance, e.g. if you receive a sports massage. These professionals are self employed and any service they provide or another third party provides is between them and you. Pride Performance are not liable for, or responsible of, any monies paid or any financial disputes between yourselves and the party. We are not liable or responsible for any other disputes which may arise between yourselves and the party. You must book any of these services with the third party themselves and not with ourselves. We may pass on contact information if requested however this does not leave us with liability of any agreements.

We will not be liable to you for any loss, damage or theft of any property you bring onto our premises or of any vehicles, bikes or other modes of transport and personal property which are parked within the car park.
